As wrapping paper has been neatly folded and ironed, ready to be re-used next Christmas, and everyone is busy enjoying their presents, it is prudent to raise the question whether the carefully selected gifts really contained genuine goods – or fakes.

It has been claimed that design as Intellectual Property has been overlooked in the IP world and in the EU in particular, as the category has somewhat suffered due to the inconsistency in rulings in Europe. However, in the wake of the high-profile case of Apple Vs Samsung, best described as legal trench warfare, this could very well change. In fact, lawyers are now more frequently advising their clients not to leave design behind when IP rights are protected.
